Terms and conditions
Terms and Privacy Policy for the prize draw “€100 BAUFIX Voucher for your next project!”
The following conditions apply:

2. Participants
Eligible to participate are people who have reached the age of 18.
Participation via competition clubs, entry or registration services, automated entries, or participation with false identities or those of third parties is not permitted.
Participants may be required to prove their eligibility (e.g. age) for the prize draw. If participants do not provide proof within the timeframe set by BAUFIX, BAUFIX reserves the right to exclude them from participation.
3. Prizes
One €100 ONLINE SHOP voucher code will be drawn among all participants.
4. How to participate
The prize draw runs online from 17.04.2025 to 04.05.2025.
Each participant as a natural person can enter the prize draw.
To take part, participants must:
- Read and acknowledge the terms and privacy policy.
- Follow @baufix_online on Instagram
- Like the prize draw post
- Mention a person in the comments section of the post.
If you win, you must additionally (by private/direct message if necessary) provide the following information:
- Full name
- Email address (if you’d like the prize sent by email)
You will then receive an email or direct message and be asked to provide these details.
Participation is not dependent in any way on the purchase/acquisition of a product or on subscribing to a newsletter.
5. Winner selection, notification, and prize delivery
The winners will be drawn by lot. You will be notified by email or direct message within 5 days of the draw. The draw will likely take place on 05.05.2025.
Prizes will be delivered either via direct message or, if requested, by email.
The delivery address cannot be changed after the initial notification. If a prize cannot be assigned, BAUFIX is not obliged to make further inquiries. In such cases, claims to the prize expire.
6. Exclusion of participants
BAUFIX reserves the right to exclude participants who provide false or incomplete information, use unauthorized means, are suspected of manipulation, or in any other way breach the terms and conditions, without stating reasons.
If exclusion criteria are met, prizes may be subsequently revoked or already issued/delivered/paid-out prizes reclaimed.
BAUFIX may, in case of suspicion, require a statement from the participant. If the participant does not reply within the set timeframe, BAUFIX reserves the right to exclude them.
Employees of BAUFIX, affiliated companies, or cooperation partners of the prize draw, and persons involved in its organization or previously involved, and their relatives (first and second degree) as well as life partners in a similar domestic community are excluded from participation. The same applies to further exclusion criteria listed under “Participants.”
7. No prize delivery
If delivery to the winner is not possible (e.g. if the claim to the prize is lost according to the terms and conditions or the winner does not accept the prize), BAUFIX may decide at its discretion what happens to the prize (e.g. whether it will be given to another participant or retained for another draw).
8. Liability exclusion
BAUFIX accepts no responsibility for data loss, particularly where caused by data transmission, technical faults, or lost/damaged/late submissions due to network, hardware, or software issues.
Any warranty claims by winners are excluded, except where:
- There is liability for injury to life, body, or health resulting from grossly negligent breach by BAUFIX or its legal representatives or agents;
- Liability arising from product liability law.
9. Amendment/Suspension of the prize draw
BAUFIX reserves the right to amend or discontinue the prize draw in case of unforeseen circumstances.
BAUFIX is entitled to cancel or suspend the draw in the event of attempted manipulation or if proper execution can no longer be ensured, in particular in case of equipment or software failures, programming errors, or technical/legal issues.
10. Partial invalidity
If any clause is ineffective, the validity of the remaining terms is unaffected.
11. Transfers, payout, legal process
There is no right to a cash alternative. Any claims are non-transferable. Legal recourse is excluded.
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods, even for orders from abroad.
12. Consumer dispute resolution
The European Commission provides an online dispute resolution platform at http://ec.europa.eu/consumers/odr/. Consumers may use this platform to settle disputes. We always aim to resolve contractual disagreements and complaints amicably. Please note, however, that we are not obliged to participate in a dispute resolution process before a consumer arbitration board, nor can we offer participation in such processes.

The following privacy notice applies to the processing of personal data as part of the competition.

c. Scope, purpose, and legal basis of data processing
To participate in the BAUFIX “€100 voucher for your next project!” draw, in addition to following, liking, or tagging, the following personal data may be required:
Your age, where necessary, to verify adult status.
We process participants’ personal data to carry out the prize draw, determine winners, and notify them. If you win, we may ask for your first and last name via private message to prevent unauthorized or multiple entries.
We need your data to send you your prize or verify your identity/record your acceptance declaration or, in case of an offense, to enforce our rights. If we do not collect this data, participation or contact for a prize notification is not possible.
Data processing is therefore necessary for the conduct of the draw. The legal basis for processing personal data is Art. 6(1)(b) GDPR.
If you win, we may ask you for permission to publish your name on the platform. The legal basis in this case is your consent under Art. 6(1)(a) GDPR, which you can revoke at any time, e.g. by emailing kundenservice@baufix-online.de.
We also evaluate the draw results to measure campaign efficiency and relevance. We use prize draw data to continually improve our marketing in your interest and plan new measures. The legal basis here is Art. 6(1)(f) GDPR (legitimate interest, based on our interest in measuring and disseminating the success of competitions). You have a right to object to processing under Art. 6(1)(f) GDPR at any time. Please contact kundenservice@baufix-online.de to do so.
d. Recipients of your personal data
BAUFIX uses service providers to process your personal data, e.g. for email delivery, data storage at secure data centers, database maintenance, and analysis. Data processing takes place in Germany.
All processors involved have been carefully chosen, work strictly on BAUFIX’s instructions, and only have access to your data to the extent and for the period required for their services.
BAUFIX only passes on the data of prize winners to service providers involved in fulfilment (e.g. DHL, DPD, as necessary for dispatch). Your data will not be transferred to third parties unless necessary for the competition and permitted by law.
e. Storage period
We process and retain your data only as long as required for the stated purposes. We delete it after the prize draw ends, unless a longer retention is required by commercial or tax law. Retention periods are usually six or ten years.
If you win, we retain your data for at least the statutory limitation period, generally three years, to check possible warranty claims. Retention after the end of the draw is then based on Art. 6(1)(c) GDPR together with the applicable law.
Please note your post will not be deleted by us after the competition. You can always delete it yourself from the platform.
f. Your data subject rights
If BAUFIX processes your personal data, the following rights apply:
Right of access (Art. 15 GDPR):
You have the right to obtain confirmation of whether your personal data is processed, and, if so, access to those data and the information listed in Art. 15 GDPR.
Rectification (Art. 16 GDPR):
You have the right to have inaccurate data corrected and incomplete data completed without delay.
Erasure (Art. 17 GDPR):
You have the right to have personal data erased without delay under certain conditions (listed in Art. 17 GDPR).
Restriction of processing (Art. 18 GDPR):
You have the right to restrict processing where one of the requirements of Art. 18 GDPR is met (e.g., pending verification of legitimate grounds).
Data portability (Art. 20 GDPR):
In certain circumstances under Art. 20 GDPR, you have the right to receive your personal data in a portable, machine-readable format or have it transmitted to a third party.
Right to withdraw consent (Art. 7 GDPR):
If processing is based on your consent, you may withdraw it at any time under Art. 7(3) GDPR. Withdrawal applies only for the future; any processing carried out up to that point remains unaffected.
Right to object (Art. 21 GDPR):
If processing is based on legitimate interest under Art. 6(1)(f) GDPR, you have the right, on grounds relating to your particular situation, to object. We will then stop processing unless we can demonstrate compelling legitimate grounds or processing is for the establishment, exercise, or defense of legal claims.
Right to lodge a complaint (Art. 77 GDPR):
You have the right to lodge a complaint with a supervisory authority if you believe your data is being processed unlawfully. The authority may be in your habitual place of residence, workplace, or where the breach is suspected to have occurred.
