Terms and conditions of participation
Conditions of participation and data protection information for the prize draw “€100 BAUFIX voucher for your next project!”
The following conditions apply:

2. Participants
Participation is open to individuals who are at least 18 years old.
Participation via competition clubs or entry services, automated participation as well as participation with fake identities or identities of third parties is not permitted.
Participants may be required to prove their eligibility to participate in the prize draw (e.g. age). If participants do not provide proof of eligibility within the deadline set by BAUFIX, BAUFIX reserves the right to exclude them from participation.
3. Prizes
Among all participants, one €100.00 voucher code for our online shop will be raffled.
4. How to enter
The prize draw takes place online from 17/04/2025 to 04/05/2025.
Every participant as a natural person can take part in the prize draw.
To enter the prize draw, participants must, at the time of entry:
- Read the conditions of participation and take note of the data protection information.
- Follow @baufix_online on Instagram
- Like the prize draw post
- Tag one person in the comments section of the post.
In the event of a win, it will be necessary to additionally provide the following information (if applicable via private/direct message):
- First name, last name
- Email address, if applicable (if you would like the prize to be sent there)
For this purpose, you will receive an email or direct message and be asked to submit this information.
Participation in the prize draw and the chances of winning are in no way dependent on the purchase of a product or subscription to a newsletter.
5. Selection and notification of winners, prize delivery
The winners will be determined by random draw. They will be notified by email or direct message no later than 5 days after the draw. The draw is expected to take place on 05/05/2025.
The prize will be delivered either by direct message or, upon request, by email.
The address cannot be changed after it has been provided for the first time. In the event that a prize cannot be allocated, BAUFIX is not obliged to make further inquiries. In this case, the claim to the prize expires.
6. Exclusion of participants
BAUFIX reserves the right to exclude participants from the prize draw without giving reasons if they provide false or incomplete information, use unauthorized aids, are suspected of manipulation or otherwise violate these conditions of participation.
If the conditions for exclusion are met, prizes may be subsequently revoked or prizes already issued, delivered or paid out may be reclaimed.
BAUFIX reserves the right to request a statement from the participant if there is suspicion of grounds for exclusion. If no statement is made within the deadline set by BAUFIX, BAUFIX reserves the right to exclude the participant from the prize draw.
Employees of BAUFIX and its affiliated companies within the meaning of corporate law, employees of cooperation partners of the respective prize draw and all persons involved in the implementation of the prize draw are excluded from participation. The same applies to relatives (Section 15 of the German Fiscal Code) in the first and second degree of these persons, as well as their partners in a marriage-like relationship.
Further grounds for exclusion are set out under the section “Participants”.
7. No prize delivery
If it is not possible to deliver the prize to the winner (e.g. because the claim to the prize has lapsed under these conditions of participation or the winner does not accept the prize), BAUFIX is free to decide at its own discretion what to do with the prize (e.g. whether the prize will be awarded to non-winning participants in accordance with these conditions of participation or not awarded and, for example, used for another prize draw).
8. Exclusion of liability
BAUFIX accepts no responsibility for data losses, in particular those that occur during data transmission, for technical defects, or for lost, damaged or delayed entries that are due to network, hardware or software problems.
Any warranty claims by the winners are excluded, except where:
- Liability is for damages resulting from injury to life, limb or health caused by grossly negligent breach of duty by BAUFIX or by intentional or grossly negligent breach of duty by a legal representative or vicarious agent of BAUFIX;
- Liability is for damages under product liability law.
9. Modification/termination of the prize draw
BAUFIX reserves the right to modify or terminate the prize draw in the event of unforeseen circumstances.
In particular, BAUFIX is entitled to terminate, discontinue or suspend the prize draw if
- an attempted misuse through manipulation is detected, or
- proper implementation can no longer be guaranteed, in particular in the event of hardware or software failures, program errors, as well as mechanical, technical or legal problems.
10. Severability clause
If any clause of these conditions is or becomes invalid, the validity of the remaining conditions shall not be affected.
11. Transfer, cash payment, legal recourse
There is no entitlement to a cash payment of the prize. Any prize claims are not transferable. Legal recourse is excluded.
Otherwise, German law shall apply with the exclusion of the UN Convention on Contracts for the International Sale of Goods, even if delivery is made from abroad.
12. Consumer dispute resolution
The European Commission provides a platform for online dispute resolution, which you can find at http://ec.europa.eu/consumers/odr/. As a consumer, you generally have the option of using this platform to resolve your disputes. We always strive to settle any disagreements arising from contracts concluded with us and complaints amicably. Please note, however, that we are not obliged to participate in a dispute resolution procedure before a consumer arbitration board and cannot offer you participation in such a procedure.

The following data protection information applies to the processing of personal data in the context of the implementation of the prize draw.

c. Scope, purpose and legal basis of data processing
To participate in the BAUFIX “€100 BAUFIX voucher for your next project!” prize draw, in addition to following, liking and tagging a person, it is necessary for you to provide the following personal data:
If applicable, your age to verify that you are of legal age.
We process the participants’ personal data to carry out the prize draw, to determine the winners and to notify them. If you have won, we may also contact you via private message on the platform to ask for your first and last name so that we can exclude unauthorized and/or multiple participation.
We need your data in order to send you your prize in the event of a win and to verify your identity and/or to document your declaration of use or, in the event of a legal violation, to enforce our rights. If we do not collect the aforementioned data, participation in the prize draw or contacting you regarding a prize notification is not possible.
Data processing is therefore necessary for the implementation of the prize draw. The legal basis for the processing of personal data to fulfill this contractual obligation is Art. 6 (1) (b) of the EU General Data Protection Regulation (GDPR).
In the event of a win, we reserve the right to ask for your permission to publish your name on the platform. The legal basis in this case is your consent in accordance with Art. 6 (1) sentence 1 (a) GDPR, which you can revoke at any time, e.g. by sending a message to kundenservice@baufix-online.de.
We also evaluate the results of the prize draw in order to measure the efficiency and relevance of the campaign. We determine the success of the prize draw so that we can continuously improve our marketing activities in your interest and plan new measures. The legal basis for the described data processing is Art. 6 (1) (f) GDPR (balancing of interests, based on our interest in measuring and communicating the success of prize draws). You have the right to object to processing based on Art. 6 (1) sentence 1 (f) GDPR at any time. To do so, please contact kundenservice@baufix-online.de.
d. Recipients of your personal data
BAUFIX uses additional service providers to process your personal data, including for sending emails, storing your data in a secure data center, and maintaining and analyzing databases. Data processing takes place in Germany.
All processors involved in the processing of your personal data have been carefully selected, support BAUFIX strictly in accordance with instructions and only have access to your data to the extent and for the period necessary to provide their services.
In addition, BAUFIX only transfers the winner’s personal data to the service provider supporting BAUFIX with shipping (e.g. DHL, DPD). Beyond this, your data will not be passed on to third parties unless the transfer is necessary for the implementation of the prize draw and there is a legal basis for the transfer under data protection law.
e. Storage period
We generally process and store your personal data only for as long as it is required for the purposes for which it was collected. We therefore delete your data after the prize draw has ended, unless longer storage is necessary to fulfill commercial and tax law retention obligations. Retention periods may arise in particular from the German Commercial Code (HGB) and the German Fiscal Code (AO) and are generally six or ten years.
If you have won, we will store your data at least for the duration of the statutory limitation period, which is generally three years, in order to be able to review any warranty claims. The storage of your data after the end of the prize draw is then based on Art. 6 (1) (c) GDPR in conjunction with the relevant legal provisions.
Please note that your post will not be deleted by us after the prize draw has ended. However, you can delete it yourself on the platform at any time.
f. Your rights as a data subject
If BAUFIX processes personal data about you, you have the following rights as a data subject:
Right of access (Art. 15 GDPR):
You have the right to obtain confirmation as to whether or not personal data concerning you is being processed; if this is the case, you have the right to access this personal data and the information listed in detail in Art. 15 GDPR.
Right to rectification (Art. 16 GDPR):
You have the right to obtain without undue delay the rectification of inaccurate personal data concerning you and, where applicable, the completion of incomplete data.
Right to erasure (Art. 17 GDPR):
You have the right to obtain the erasure of personal data concerning you without undue delay where one of the grounds listed in detail in Art. 17 GDPR applies.
Right to restriction of processing (Art. 18 GDPR):
You have the right to obtain restriction of processing where one of the conditions listed in Art. 18 GDPR applies, for example if you have objected to processing, for the duration of the assessment by the controller.
Right to data portability (Art. 20 GDPR):
In certain cases, which are listed in detail in Art. 20 GDPR, you have the right to receive the personal data concerning you in a structured, commonly used and machine-readable format or to request the transmission of this data to a third party.
Right to withdraw consent (Art. 7 GDPR):
If data processing is based on your consent, you have the right under Art. 7 (3) GDPR to withdraw your consent to the use of your personal data at any time. Please note that the withdrawal only takes effect for the future. Processing that took place before the withdrawal is not affected.
Right to object (Art. 21 GDPR):
Where data is collected on the basis of Art. 6 (1) (f) GDPR (data processing for the purposes of legitimate interests), you have the right to object, on grounds relating to your particular situation, at any time to processing of personal data concerning you. In the event of an objection, we will no longer process your data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves to establish, exercise or defend legal claims.
Right to lodge a complaint (Art. 77 GDPR):
You have the right under Art. 77 GDPR to lodge a complaint with a supervisory authority if you consider that the processing of personal data relating to you infringes data protection regulations. The right to lodge a complaint may in particular be exercised with a supervisory authority in the Member State of your habitual residence, place of work or place of the alleged infringement.
